Following a trial or summary judgment, one party—or perhaps both—will typically be dissatisfied with the result. As a result, appeals are not uncommon, and the state and federal judicial systems both provide for multiple levels of appeal.

Along with final orders, interlocutory orders—those issued in the middle of a case—will also be subject to appeal in some cases. Knowing when (and how) to challenge an interlocutory order requires both trial and appellate experience. Trial litigation and appellate litigation are very different. While trial litigation focuses on the facts underlying the parties’ dispute, appellate litigation focuses on what happened at the trial level. Trial and appellate practice are very different as well, as trial practice is largely evidence-based while appellate practice is much more academic. As a result, when contemplating an appeal, it is imperative to work with a law firm that has extensive experience in this area.
